1. GENERAL PROVISIONS

1.1. These General Terms and Conditions (hereinafter referred to as the “Terms”) have been drafted pursuant to the provisions of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), and Act No. 634/1992 Coll., on Consumer Protection (hereinafter referred to as the “Consumer Protection Act”).

1.2. Make more operates the website www.makerfaire.cz (hereinafter referred to as the “Website”), where it publishes information about organized events (hereinafter referred to as the “Events”).

1.3. Pursuant to Section 1751(1) of the Civil Code, these Terms govern the mutual rights and obligations arising in connection with or on the basis of contracts concluded between customers and Make more through the Website (hereinafter collectively referred to as the “Contracts”).

1.4. A customer may be either:

  • i) a consumer within the meaning of Section 2(1)(a) of the Consumer Protection Act (hereinafter referred to as the “Consumer”), or
  • ii) a person other than a consumer. (these two types of customers are hereinafter collectively referred to as the “Customer”).

2. PURCHASE OF TICKETS FOR THE EVENT

2.1. If the Customer wishes to obtain a ticket for a selected Event, they shall enter into a purchase and service agreement with Make more (hereinafter referred to as the “Contract”). Under this Contract, Make more undertakes to organize the Event as described on the Website, deliver the tickets to the Customer without undue delay after the admission fee has been paid, and allow the Customer holding a valid ticket to participate in the Event under the specified conditions. The Customer undertakes to pay the admission fee.

2.2. The individual types of Event tickets, including information about the Events and their prices, are available on the Website, specifically in the Event ticket order form. All fees and prices are stated in Czech Korunas (CZK) and are inclusive of all applicable fees and taxes.

2.3. Valid Event tickets can be purchased solely and exclusively through the Website, or by concluding an individual agreement with Make more. Valid tickets cannot be purchased through resellers or other third-party companies. Make more shall not recognize any ticket as valid other than an official ticket from the Website or a ticket provided on the basis of an individual agreement concluded with Make more.

2.4. The Customer will be informed of the accepted payment methods no later than at the beginning of the ordering process.

2.5. To conclude the Contract, the Customer first selects the desired type of Event ticket in the order form and then fills in the required data. The order form contains, in particular, information regarding:

  • a) the Customer’s identification and contact details,
  • b) the ordered ticket type and information about the Event,
  • c) the services included in the specific ticket type,
  • d) the method of payment for the ticket price, (hereinafter collectively referred to as the “Order”).

2.6. Before submitting the complete Order, the Customer is given the opportunity to check and modify the data entered into the Order, allowing the Customer to correct any errors made during data entry. The Customer submits the Order to Make more by clicking the “Order” button, after which they will be redirected to a page containing the payment details.

2.7. The Contract between the Customer and Make more is concluded upon payment of the Order. The Order is deemed paid upon the crediting of the funds to the bank account of Make more. As soon as possible after the conclusion of the Contract, Make more will send a confirmation of the concluded Contract, including the text of these Terms, to the Customer’s email address.

2.8. In the event that an incorrect price is displayed on the Website and an Event ticket order is placed at this incorrect price, Make more reserves the right to cancel the Order. In such a situation, Make more will promptly inform the Customer via email about the cancellation of the Order and refund the paid amount to the Customer.

2.9. Make more may withdraw from the Contract if it is obvious that the Customer intentionally provided incorrect information in the Order. If the Customer is not a Consumer, Make more is entitled to withdraw from the Contract at any time, even without stating a reason.

2.10. The Customer agrees to the use of means of distance communication for the purpose of concluding the Contract. Any costs incurred by the Customer when using means of distance communication in connection with the conclusion of the Contract (such as internet connection costs) shall be borne by the Customer themselves, and these costs do not exceed the standard basic rate.

3. PRICE AND PAYMENT CONDITIONS

3.1. In the event of a discrepancy between the price stated next to the Event ticket on the Website and the price stated in the Order, the price stated in the Order shall always prevail.

3.2. The Customer may pay the price and any costs associated with obtaining the Event ticket under the Contract to Make more via bank transfer. The bank transfer details will be made available to the Customer after the Order is created and will simultaneously be sent to the email address specified in the Order. Alternatively, payment can be made via a fast bank transfer through the ComGate provider or by credit/debit card via the ComGate payment gateway. In both cases, the payment is governed by the terms and conditions of this payment system. If the Customer wishes to use a different payment method, they may contact Make more to conclude an individual Contract, which shall be governed mutatis mutandis by these Terms to a reasonable extent.

3.3. After the price has been paid, an invoice/tax document will be issued and sent to the Customer’s email address specified in the Order.

4. TICKET DELIVERY AND EVENT PARTICIPATION

4.1. Upon fulfilling the set conditions (in particular, completing the data in the Order and making the payment), the Customer has the right to have the paid Event tickets made available to them.

4.2. Tickets will be sent to the Customer in electronic format to the email address specified in the Order without undue delay after the respective payment is credited to the bank account of Make more, or after the Customer’s payment is identified.

4.3. Make more bears no responsibility for the non-delivery of a ticket for the selected Event to the Customer due to reasons on the part of the Customer, particularly if it is impossible to deliver the ticket to the specified email address (e.g., due to a full inbox, spam filters, etc.).

4.4. The Customer is entitled to a refund of the admission fee only in the cases and under the conditions specified below. The Customer has no right to a refund of the admission fee solely because they did not attend the selected Event, regardless of the reason.

4.5. By purchasing a ticket for a selected Event, the Customer undertakes to comply with the rules established by Make more (stated on the Website in the Event description or posted at the Event venue) and to follow the venue regulations and visitor rules of the respective Event venue.

4.6. Make more reserves the right to change the program of the Events, as well as their dates and venues. By purchasing an Event ticket, the Customer acknowledges this right of Make more.

4.7. In the event that Make more changes the venue or date of an Event, or cancels the Event entirely, the Customer will be notified of this fact. Make more is not liable to the Customer if they cannot be reached in time via their contact details, nor is it liable if the Customer receives a timely sent notification with a delay.

4.8. If Make more changes the date or venue of an Event, the Customer has the right to a refund of the admission fee. The Customer may exercise this right no later than the fifth (5th) business day following the original date of the Event, and only if the ticket has not yet been used. If the Customer does not exercise their right within this period, it is deemed that they wish to attend the Event on the modified date or at the modified venue. If the date or venue of the Event is changed due to circumstances beyond the organizer’s control constituting force majeure (e.g., natural disasters, epidemics, public authority decisions), the Event ticket remains valid for the altered date or venue, and the Customer is not entitled to a refund of the admission fee.

4.9. If Make more cancels an Event completely, the Customer has the right to a refund of the admission fee.

4.10. If the conditions for a refund of the admission fee are met, the fee will be returned to the Customer’s bank account from which the payment was made, or by another method agreed upon between the Customer and Make more.

4.11. Make more is entitled to cancel or void a ticket if the Customer breaches their obligations set forth in these Terms, particularly if Make more has reasonable suspicion that multiple persons are attempting to enter the Event using a single ticket when not authorized by the ticket. In such a case, the Customer is not entitled to a refund of the admission fee.

5. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE

5.1. If the Customer does not receive the Event ticket within one (1) hour after paying the admission fee, they are obliged to immediately, but no later than within twenty-four (24) hours from the expiry of the aforementioned delivery period, contact Make more and report that they have not received the paid ticket. For this purpose, the Customer must provide Make more with the first name, last name, email, and phone number used to purchase the ticket. If Make more finds that the Event ticket was indeed not delivered to the Customer due to a reason on the part of Make more, the procedure will be as follows:

  • a) Make more undertakes to resend the ticket to the email specified by the Customer no later than within twenty-four (24) hours, but no later than one (1) hour before the Event takes place,
  • b) if the Event has already taken place, Make more undertakes to refund the paid admission fee to the Customer no later than within thirty (30) days from the date the claim was submitted.

5.2. If the Customer is a Consumer, the Customer’s rights and obligations regarding rights arising from defective performance are governed by the relevant generally binding legal regulations, in particular Sections 2099 to 2117 and Sections 2161 to 2174b of the Civil Code, and the Consumer Protection Act.

5.3. In the event that the Event ticket issued by Make more or the execution of the Event by Make more has a defect, the Customer is entitled to report the defect and exercise their rights arising from defective performance (i.e., file a claim). The contracting parties agree that the following shall not be deemed a defect of the ticket or the Event:

  • a) A change in the Event program that is immaterial with respect to the Event as a whole (in particular, a change in the Event schedule consisting only of an insubstantial delay or a different arrangement of agenda slots at the Event, or the replacement of one of several performers, provided it is not the main performer, or if the replacement occurred due to force majeure, particularly due to the illness of the performer).

5.4. The Customer may file a claim regarding an Event ticket or the Event via email or at the business premises of Make more. When filing a claim, the Customer must choose how they wish the defect to be resolved; this choice cannot be subsequently changed without the consent of Make more.

5.5. If the provided performance is defective, the Customer has the right to have the defect rectified by the delivery of a new performance without defects or by the delivery of the missing part of the performance (typically the delivery of a new Event ticket); or to have the defect rectified by repairing the performance, unless the chosen method of rectifying the defect is impossible or disproportionately costly compared to the alternative method. This will be assessed in particular with regard to the significance of the defect, the value the performance would have without the defect, and whether the defect can be rectified by the alternative method without significant difficulty for Make more.

5.6. Furthermore, the Customer has the right to a reasonable discount on the purchase price or to withdraw from the Contract if:

  • a) Make more refuses to rectify the defect or fails to rectify it in accordance with legal regulations;
  • b) the defect manifests itself repeatedly;
  • c) the defect constitutes a material breach of the Contract; or
  • d) it is apparent from Make more’s statement or the circumstances that the defect will not be rectified within a reasonable time or without significant difficulty for the Customer.

5.7. The Customer is not entitled to withdraw from the Contract if the defect in performance is insignificant.

5.8. Upon submission of a claim, Make more will issue a written confirmation to the Customer stating the date the claim was filed, its content, the method of claim resolution requested by the Customer, and the Customer’s contact details for the purpose of providing information on the resolution of the claim.

5.9. Unless Make more and the Customer agree on a longer period, Make more will settle the claim and provide the Customer with information regarding its resolution via the specified contact details within thirty (30) days of receiving the claim. If this period expires without a resolution, a Customer who is a Consumer may withdraw from the Contract or demand a reasonable discount.

5.10. Make more will inform the Customer about the resolution of the claim via email and issue a confirmation stating the date and method of resolution. If the claim is justified, the Customer is entitled to reimbursement of reasonably incurred expenses, which the Customer must substantiate.

5.11. If the Customer is not a Consumer, it is their obligation to report and object to the defect in performance without undue delay after they could have discovered it, but no later than within three (3) days from the date the Event took place.

6. INFORMATION FOR CONSUMERS

6.1. For the avoidance of doubt, if the Customer is a Consumer, the provisions of this section of the Terms also apply to the contractual relationship. If the Customer is not a Consumer, the provisions of this section do not apply.

6.2. In accordance with the provisions of Section 1837(j) of the Civil Code, the Customer does not have the right to withdraw from the Contract concluded between the Customer and Make more within fourteen (14) days without giving reasons, given that this is a contract relating to leisure activities and the performance is provided by Make more on a specific date or within a specific period.

7. FINAL PROVISIONS

7.1. These Terms and the Contract are governed by the laws of the Czech Republic.

7.2. Both the Contracts and the Terms are executed in the Czech language. Once the Customer concludes a Contract with Make more, it will be stored in electronic format by Make more and will not be accessible to the Customer.

7.3. In the event of a consumer dispute between the Customer and Make more that cannot be resolved by mutual agreement, the Customer may submit a proposal for alternative dispute resolution (ADR) to the designated body, which is: The Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, Email: adr@coi.cz, Web: adr.coi.cz.

7.4. To file a complaint regarding the performance provided in connection with the Contracts and to locate an alternative dispute resolution entity, a Customer who is a Consumer may also use the Online Dispute Resolution (ODR) platform established by the European Commission at: http://ec.europa.eu/consumers/odr/.

7.5. The provisions of these Terms form an integral part of the Contract. The Customer confirms that they were alerted to the existence of these Terms prior to concluding the Contract, have familiarized themselves with them, and express their agreement with them.

7.6. Make more may unilaterally change or supplement the text of these business terms; however, this does not affect the rights and obligations that arose during the period of effectiveness of the previous version of the Terms.

7.7. Provisions deviating from these Terms may be agreed upon in a specific Contract. Such deviating arrangements shall take precedence over the wording of these Terms.

7.8. If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.

7.10. The Customer and Make more agree to communicate via electronic mail. The email address of Make more is specified in the header of these Terms, and the email address of the Customer is specified in the Order.

7.11. In the event of force majeure or events that cannot be foreseen (natural disasters, pandemics, operational failures, subcontractor outages, etc.), Make more shall not be held liable for damage caused as a result of or in connection with such force majeure cases. Should the force majeure event continue for a period exceeding thirty (30) days, the contracting parties agree that Make more has the right to withdraw from the Contract.

7.12. These Terms become effective as of March 20, 2025.
