PRIVACY POLICY

I. Basic Provisions

  1.   2. The processing of personal data is carried out in accordance with the GDPR, Act No. 110/2019 Coll., on Personal Data Processing, and Act No. 480/2004 Coll., on Certain Information Society Services, as amended.

  4. “Personal data” means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

II. Sources and Categories of Processed Personal Data

  1. The Controller processes personal data provided by you or personal data obtained by the Controller within the scope of mutual cooperation.
  2. The Controller processes your identification and contact data, as well as any data necessary for fulfilling the purpose of the cooperation.
  3. The purpose of the cooperation is:
    • a) the organization of Maker Faire festivals by the Controller, through which the Controller supports the maker movement in the Czech Republic, aiming to popularize technology and creative making as an alternative to a mainstream consumer lifestyle, and
    • b) your participation in Maker Faire festivals or any other form of cooperation (provision of information, support, etc.) related to the Controller’s activities.
  4. The Controller further processes your personal data if you visit the website https://makerfaire.cz/, provided that you have not disabled the storage of cookies in your browser settings.

III. Legal Basis and Purpose of Personal Data Processing

  1. The legal basis for the processing of personal data is:
    • the provision of information and other data based on your consent to the processing of your personal data pursuant to Article 6(1)(a) of the GDPR,
    • the performance of a contract between you and the Controller pursuant to Article 6(1)(b) of the GDPR,
    • the legitimate interest of the Controller in conducting direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,
    • your prior consent to the processing of your personal data for the purposes of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, where no order for goods or services has been placed.
  2. The purpose of processing personal data is:
    • the exercise of rights and obligations arising from the contractual relationship between you and the Controller; when entering into a contract, personal data required for the successful processing of the order (first name, last name, Corporate ID, registered office/address, contact details, etc.) are requested; the provision of personal data is a necessary requirement for the conclusion and performance of the contract, and without the provision of personal data, it is not possible to conclude or perform the contract on the part of the Controller,
    • the exercise of rights and obligations arising from your participation in the Maker Faire festival; when registering for participation in the Maker Faire festival, personal data required for the organization of the festival (first name, last name, Corporate ID, registered office/address, contact details, etc.) are requested; the provision of personal data is a necessary requirement for the organization of the festival, and without the provision of personal data, the Controller cannot fulfill its respective obligations towards you as a festival participant,
    • sending commercial communications and executing other marketing activities,
    • communication between you and the Controller,
    • the fulfillment of other legal obligations.
  3. By submitting an application via the website https://makerfaire.cz/, you consent to the taking of photographs and video recordings at the festival and to the use of these audiovisual works for the promotion of the Controller and for public information regarding the Controller’s activities.

IV. Data Retention Period

  1. The Controller retains personal data:
    • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from such contractual relationships (for a period of 3 years from the termination of the contractual relationship),
    • for the period necessary to exercise the rights and obligations arising from the organization of and participation in the Maker Faire festival (for a period of 3 years from the date of the festival),
    • until consent to the processing of personal data for marketing purposes is withdrawn (for a maximum of 3 years), if the personal data is processed based on consent.
  2. Upon expiry of the retention period, the Controller shall permanently delete or erase the personal data.

V. Recipients of Personal Data (Subcontractors of the Controller)

  1. Recipients of personal data are persons:
    • involved in the organization, hosting, and other activities related to the Maker Faire festival,
    • providing website operation, hosting, and maintenance services in connection with the website https://makerfaire.cz/,
    • providing marketing and promotional services.
  2. The Controller does not intend to transfer personal data to a third country (outside the EU) or to any international organization.
  3. The Controller primarily processes personal data internally using its own means; however, in certain cases, personal data may also be processed by third-party processors who provide software, services, and applications, such as cloud service providers, email service providers, or other software tools and IT infrastructure.
  4. The aforementioned personal data will be transferred solely for the purposes stated above and will be processed in this manner only until your consent is withdrawn. You may withdraw this consent at any time.

VI. Your Rights

  1. Under the conditions set forth in the GDPR, you have:
    • the right of access to your personal data pursuant to Article 15 of the GDPR,
    • the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR,
    • the right to erasure of personal data pursuant to Article 17 of the GDPR,
    • the right to object to processing pursuant to Article 21 of the GDPR,
    • the right to data portability pursuant to Article 20 of the GDPR, and
    • the right to withdraw consent to processing, either in writing or electronically, via the physical address or e-mail of the Controller specified in Section I of this Policy.
  2. Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection, located at Pplk. Sochora 27, 170 00 Prague 7 (https://uoou.gov.cz/), if you believe that your right to personal data protection has been violated.

VII. Personal Data Security Conditions

  1. The Controller declares that it has adopted all appropriate technical and organizational measures to ensure the security of personal data.
  2. The Controller has implemented technical measures to secure data storage facilities and physical repositories of personal data held in paper form.
  3. The Controller declares that only persons authorized by the Controller have access to personal data.

VIII. Cookies

  1. When you visit the website https://makerfaire.cz/, regardless of whether you are a registered user or not, please be advised that we use cookies. By means of cookies, we collect certain information about you, your device, and your browsing behavior on the Website. Based on this data, we optimize the Website to make it more user-friendly, improve our services, and deliver targeted advertising.

IX. Final Provisions

  1. By submitting an application or granting consent to receive information via the online order form, you confirm that you are familiar with these privacy policy terms and accept them in their entirety.
